Texas Debt Lawsuits Are Surging — Reaching the People Who Need a Defense Attorney Now

Debt collection lawsuits filed in Texas courts have jumped 177% since 2019, according to research published by The Pew Charitable Trusts in 2025 — one of the sharpest increases of any state Pew tracked. Most of the people on the receiving end of those filings never see a courtroom the way they’d expect to. A separate study of Justice Courts in Harris County found that nearly 9 out of 10 Texans sued over a debt lose the case, and 75% of those losses come by default judgment — meaning the person never answered, and the debt collector won without having to prove a thing. Only about 1 in 10 defendants had a lawyer at all.

That combination — a rising volume of lawsuits and a defendant pool that’s almost entirely unrepresented — is exactly where a debt defense attorney can make the biggest difference. It’s also exactly why timing matters more than almost any other factor in how you market to these clients.

Why the Clock Is the Whole Game

Once someone is served with a debt collection lawsuit in Texas, they typically have a narrow window to file an answer before a default judgment locks them into wage garnishment or a bank levy. Miss that window, and the case is effectively over before it started. A person who just got served isn’t browsing law firm websites at their leisure — they’re trying to figure out, fast, whether they have options and who can help. If your firm isn’t in front of them during that specific window, a competitor will be.

Many of these defendants also don’t realize they have a real defense available — an expired statute of limitations, a debt buyer that can’t prove ownership of the account, or a filing error that should have gotten the case thrown out. Without a lawyer in the picture, none of that gets raised, and the default judgment stands. That gap between “has a defense” and “knows they have a defense” is where marketing that actually reaches people in time earns its keep.

Why Broad Advertising Doesn’t Solve This

A billboard on I-35 or a general social ad reaches a huge number of Texans, but almost none of them are mid-lawsuit right now. CaseHunter’s Texas campaigns are built the opposite way: hyper-targeted outreach to people in Houston, Dallas, San Antonio, Austin, and the counties around them who are actively dealing with a debt-related legal matter in your practice area, not a broad list of residents who might need a lawyer someday.

That same targeting extends to firms handling debt defense and bankruptcy work, where reaching someone early — before a default judgment is entered — is the difference between a case you can still fight and one that’s already lost.

Why One Channel Isn’t Enough Anymore

Direct mail remains the backbone of an effective campaign — a letter in the mailbox of someone who was just served tends to get noticed. But that same person is also checking their inbox and scrolling social media while they’re trying to figure out what to do next. Targeted email marketing puts your firm in front of that same qualified individual a second time, using the same underlying targeting that drives your mail campaign — not a separate, generic list. Social media marketing adds a third touchpoint, reinforcing your name in a different context.

Firms running all three channels together, aimed at the same in-market individuals, tend to see faster recognition and more calls than any single channel alone — which matters when the person you’re trying to reach may have as little as three weeks to act.

What This Means for Your Firm

Texas’s debt lawsuit numbers aren’t slowing down, and with roughly nine in ten defendants losing their case — most without ever answering — the gap between “needs a lawyer” and “has a lawyer” is wide open. If your firm handles debt defense, judgment defense, or bankruptcy work anywhere in Texas, the opportunity isn’t just that more people need you. It’s that most of them don’t yet know you exist, and they don’t have much time to find out.
